Mediation is a confidential way to resolve disputes without giving the decision-making power to a judge or jury.  It involves a neutral third party who helps the parties communicate and conclude their dispute on mutually acceptable terms.  Mediation often produces outcomes that are not available through litigation.  Increasingly, parties use mediation to avoid litigation altogether by exploring how to resolve their differences before either side resorts to the courts.
Arbitration is a process in which the parties to a dispute submit their positions to a neutral third party (the arbitrator) for resolution.  Since arbitration uses rules of evidence and procedure that are less formal than those followed in court, it usually leads to faster, less-expensive resolutions.  Arbitrations can either be binding or non-binding.


Private Judging is a process in which the parties present evidence and arguments to a neutral third party who typically is chosen because of his or her experience in a particular field.  Private judges usually reach decisions quicker than courts.  Private judges also afford the parties a more confidential forum than is available from courts.
